Welcome to Oliver Visuals.

These Terms & Conditions govern your use of https://olivervisuals.co/ and, where applicable, photography services provided through Oliver Visuals.

By accessing this website or requesting our services, you agree to these Terms.

If you enter into a separate written photography agreement, proposal, quotation, or contract with Oliver Visuals, that agreement will control if it conflicts with these general Terms.

1. About Oliver Visuals

Oliver Visuals operates a photography website providing photography-related content, information, and professional photography services.

Services may be available to clients in different countries depending on project requirements, location, availability, and other arrangements.

2. Website Use

You may use this website for lawful personal or business purposes.

You must not:

  • Attempt to damage or disrupt the website
  • Attempt to gain unauthorized access to the website or its systems
  • Introduce malicious software, viruses, or harmful code
  • Scrape or automatically extract substantial amounts of website content without authorization
  • Copy or republish protected website content without permission
  • Use the website for fraudulent or unlawful purposes
  • Misrepresent your identity when contacting us

We may restrict access to the website where reasonably necessary for security or legal reasons.

3. Photography Services

Photography services may vary depending on the type of project, location, schedule, and client’s requirements.

Before work begins, details may be confirmed through a quotation, proposal, email, invoice, booking agreement, or separate contract.

Project-specific terms may include:

  • Photography location
  • Shoot duration
  • Number of photographers
  • Deliverables
  • Number of final images
  • Editing requirements
  • Delivery timeframe
  • Usage rights
  • Price
  • Deposit
  • Remaining payment
  • Travel expenses
  • Cancellation terms
  • Rescheduling terms

Project-specific written terms will take priority over conflicting general provisions on this page.

4. Quotes and Pricing

Prices displayed on the website, where provided, may be estimates or starting prices unless specifically stated otherwise.

Photography projects can vary considerably, so a final quotation may depend on factors such as:

  • Location
  • Photography type
  • Duration
  • Travel
  • Equipment
  • Number of photographers
  • Editing requirements
  • Licensing requirements
  • Production requirements
  • Delivery deadlines

Quotes may have an expiry date.

Additional work requested after a project has been agreed may result in additional charges.

5. Booking and Payment

A photography booking is not considered confirmed until any required booking requirements have been completed.

These may include:

  • Acceptance of a quotation
  • Signing an agreement
  • Payment of a deposit
  • Written confirmation from Oliver Visuals

Payment requirements will be provided before or during the booking process.

Unless otherwise agreed, outstanding balances must be paid according to the payment deadline stated in the relevant invoice, quotation, or agreement.

6. Deposits

Some photography projects may require a deposit to reserve a date or begin work.

Whether a deposit is refundable, transferable, or non-refundable will be stated in the applicable quotation, invoice, or service agreement.

If no deposit requirement has been provided, this section does not create one automatically.

7. Cancellations and Rescheduling

Cancellation and rescheduling conditions may vary depending on the photography project.

Any project-specific cancellation or rescheduling policy provided in writing will apply.

Factors such as reserved dates, travel expenses, accommodation, equipment rentals, third-party bookings, and work already performed may affect the amount that can be refunded.

If Oliver Visuals must cancel a photography project and cannot provide an agreed alternative, amounts paid for services that have not been performed will be handled according to the applicable project agreement and law.

8. Client Responsibilities

Clients are responsible for providing accurate information and reasonable cooperation necessary for the photography project.

Depending on the project, clients may also be responsible for:

  • Providing access to the photography location
  • Obtaining permissions for locations they control
  • Obtaining permissions relating to products, trademarks, artwork, or other materials supplied by the client
  • Ensuring participants arrive at the agreed time
  • Providing accurate schedules
  • Informing Oliver Visuals about relevant venue rules or restrictions
  • Obtaining permissions that the client has specifically agreed to obtain

Delays caused by the client, venue, participants, weather, travel, or third parties may affect the shoot schedule and deliverables.

9. Photography Conditions

Photography can be affected by circumstances outside reasonable control, including:

  • Weather
  • Lighting
  • Venue restrictions
  • Equipment restrictions
  • Access limitations
  • Travel delays
  • Participant availability
  • Safety conditions
  • Unexpected events

Oliver Visuals will make reasonable efforts to complete agreed services, but exact photographs, poses, backgrounds, weather conditions, or creative outcomes cannot always be guaranteed unless specifically agreed in writing.

10. Editing and Creative Style

By hiring Oliver Visuals, the client acknowledges that photography involves creative judgment.

Editing may include reasonable adjustments to areas such as:

  • Exposure
  • Color
  • Contrast
  • Cropping
  • Composition
  • Basic retouching

Extensive manipulation or additional retouching may be treated as additional work unless included in the agreed service.

The photography style shown in our portfolio may be used as a general indication of our creative approach, but individual results will vary.

11. Delivery

Photography delivery methods and timelines will be agreed for individual projects where applicable.

Delivery may be made through:

  • Online galleries
  • Cloud storage
  • Download links
  • Email
  • Physical storage
  • Another agreed method

Estimated delivery dates are estimates unless expressly guaranteed in writing.

Delays caused by circumstances outside our reasonable control will not automatically constitute a breach of these Terms.

12. Raw Files

Unless specifically included in a written agreement, RAW files, unedited photographs, working files, project files, or rejected images are not automatically included with the final photography delivery.

The client receives the deliverables stated in the applicable photography agreement or quotation.

13. Copyright and Photography Usage

Unless otherwise agreed in writing, Oliver Visuals retains copyright in photographs created by Oliver Visuals to the extent permitted by applicable law.

After full payment, clients may receive a license to use the delivered photographs for the purposes agreed for the project.

Usage rights may vary depending on whether the photography is intended for:

  • Personal use
  • Website use
  • Social media
  • Editorial use
  • Advertising
  • Commercial campaigns
  • Product packaging
  • Resale or sublicensing

Commercial usage rights should be confirmed before the project where relevant.

Clients may not sell, sublicense, or transfer photography rights beyond the agreed license unless permission has been granted.

Nothing in this section overrides rights that cannot legally be excluded under applicable law.

14. Portfolio Use

Oliver Visuals may request permission to display selected work in its portfolio, website, social media, or promotional materials.

Where a project involves privacy-sensitive, confidential, or restricted content, any portfolio usage restrictions agreed with the client will be respected.

If portfolio rights are important to a project, they should be confirmed in the project-specific agreement.

Using third-party websites is at your own discretion and may be subject to separate terms.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Oliver Visuals will not be liable for indirect, incidental, special, or consequential losses arising solely from use of the website.

For paid photography services, any liability will be determined according to applicable law and the relevant photography agreement.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or restricted.

20. Client-Supplied Materials

If a client supplies logos, photographs, artwork, trademarks, music, text, designs, or other materials for a project, the client confirms that they have the necessary rights or permissions for their intended use.

Oliver Visuals is not responsible for infringement caused solely by materials supplied or specifically instructed for use by the client where Oliver Visuals reasonably relied on the client’s authorization.

21. Force Majeure

Oliver Visuals will not be responsible for failure or delay caused by circumstances reasonably outside its control.

Examples may include:

  • Natural disasters
  • Severe weather
  • Government restrictions
  • Transportation disruption
  • Widespread internet or power outages
  • Venue closures
  • Serious equipment failures despite reasonable precautions
  • Other unexpected events outside reasonable control

Where possible, reasonable efforts will be made to reschedule or find an appropriate alternative.

23. Changes to These Terms

We may modify these Terms when our website, services, or legal requirements change.

Updated Terms will be posted on this page with a revised “Last Updated” date.

Changes apply prospectively unless applicable law requires otherwise.

24. Governing Terms for Photography Projects

Individual photography projects may include a separate agreement specifying applicable law, dispute procedures, payment requirements, licensing terms, or other project-specific conditions.

Where such an agreement exists, those project-specific provisions will apply to that project.

Mandatory consumer rights available under applicable local law are not excluded by these Terms.
